1. INFORMATION ABOUT US

This site is operated by The TRUSTED CCTV Improvement Project ("we" or "us"), who will supply any documents, materials or digital services purchased through this portal.. In the event of any need to contact us with regard to either the supply of items ordered, complaints, or any other matter arising, the Purchaser ("you") may use the 'Contact' form linked from the bottom of each page on this site, or alternatively send an email to info@trustedcctv.org

 

Further alternative contact information is supplied in the Contact section of this site, although a response cannot be guaranteed to be as quick as would be provided by normal electronic communications.

 

Please note that for both communication and contractual purposes, english is the only language available at this time.

 

In the event that you wish to communicate in an alternative language, we will seek to accommodate that request if at all possible, but for contract purposes, english will remain the only acceptable language. At such time as alternative languages are made available, these Terms and Conditions will be updated accordingly.

 

 

2. PERSONAL INFORMATION

We will use a minimum of personal information in accordance with our Privacy Policy which you can find by following the link located at the bottom of each page on this site. Our policy is to positively avoid the gathering of any unnecessary personal data, to the extent that an individual representing a business or organisation, may if they so wish simply provide their job title in place of their name.

 

 

3. ORDERING

A purchaser may place an order to purchase goods advertised for sale on this site by following the on-screen prompts, displayed after clicking on the item they wish to purchase. There will be an opportunity to check and correct any errors in the order up until the point at which the order is placed by clicking the "Order" (with obligation to pay) button on the checkout page.

 

If a purchaser submits an order for goods or services via this site by clicking the Order button, their order is taken as an offer to us to buy the specified goods or services, that have been selected on this site.

We will normally confirm receipt of an order by sending the purchaser an e-mail acknowledgement, in a timely manner. 

 

Where any materials, documents or services are ordered through the e-shop, the placement of an order will only be accepted on the understanding that the purchaser waives their right to a statutory 14 day "cooling off period", during which time goods are normally returnable (further details listed under the "Right of Withdrawal" section on this site). 

 

In the event that a cooling off period is required, this should be clearly stated at the time of order, and any order processed will then be held for the statutory 14 days from the date of receipt of order, to permit a reasonable cancellation period prior to delivery. During this period, normal cancellation rules as set out in this Terms and Conditions section, will apply.

 

The contract will relate only to those specific goods which are referred to in our e-mail confirming our acceptance of the order. The purchaser should read and check the details in this e-mail to ensure that they are correct. If the details in the e-mail confirming an order are not correct, or if they are not satisfied with the details in the e-mail, we should be contacted by return, either using the feedback form linked from the 'Contact' button on each page of the site, or alternatively by sending an email to info@trustedcctv.org

 

Where we accept an order, we have a legal duty to supply goods that are in conformity with these Terms and Conditions, and english law

 

 

4. PRICE AND DELIVERY COSTS

Information displayed on this site relating to pricing is subject to change by us without notice, but those on the site at the time of any order placed will be the prices applicable to that order. Where alternative currency options are made available ( $ US dollar and € Euro for example ), the prices shown have been calculated based on £ Sterling exchange rates verified within the previous 14 days. 

 

Where additional currency exchange charges are applicable, these have already been calculated into the offer price, and therefore no further currency charges will be applied, other than in exceptional circumstances, which will be notified to the purchaser in writing, prior to the commencement of any order affected.

 

At this time ( and subject to any possible future change ), only £ Sterling and $ US currencies are supported by the e-shop, although € Euro prices are also indicated for any individuals wishing to purchase with this currency, on a direct basis. Further details on purchasing with either € Euro or alternative currencies, on a direct basis aside from the e-shop, are available on request using either the 'Contact' form or email to info@trustedcctv.org

 

Occasionally, an error may occur and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price or at all.

 

We will at our discretion either cancel an order and refund the price paid or use reasonable endeavours to contact the purchaser and ask whether they wish to continue with the order at the correct price. If we are unable to contact them or they do not wish to continue with the order at the correct price, we will cancel the order and refund any monies paid.

 

However, where the correct price of the goods is less than our displayed price, we may at our discretion, continue with the order and charge the lower amount on dispatch. Unless otherwise stated, all prices are shown without VAT and without any additional delivery costs.

 

At such time as there is a requirement for The TRUSTED CCTV Improvement Project to register for VAT purposes, all pricing will be adjusted on site accordingly, and the separate VAT component will be displayed on all subsequent order documentation.

 

No delivery costs will be applied to any materials or documents transmitted electronically, although as and when hardcopy documents are made available as an alternative format to electronic files, an indication of the additional cost of delivery will be shown alongside the product pricing, or elsewhere on the site.

 

In the event that any materials or documents are to be exported to a country where additional delivery charges will apply, a written confirmation of shipping costs will be provided prior to acceptance of any order.

 

 

5. AVAILABILITY AND DELIVERY

Information displayed on this site relating to availability is subject to change by us without notice. We cannot guarantee permanent or continuous availability of all items or services shown on this site. All orders are subject to availability at the time of ordering, and any change will be confirmed in writing to the purchaser prior to the order being accepted.

 

Delivery of electronic files will normally be in an agreed format (typically a PDF file) by attachment to an email communication, although a download option may be made available in limited or exceptional circumstances. For reasons of security or where specifically requested, documents may be either password protected or encrypted, in order to protect the contents from inappropriate access. Under such circumstances, the password or decryption key will be provided in a secure and timely manner, after the goods have been received. Where files are password protected or encrypted, we cannot guarantee that the level of security applied will be sufficient to prevent any concerted attempt to read the files, by an unauthorised person.

 

Where electronic files are to be supplied, all reasonable steps will be taken to ensure that they are free from any malicious code, in the form of a virus or any other type of malware. Upon receipt, the purchaser shall be responsible for scanning all electronic files supplied, using appropriate and up to date anti virus software, to ensure that the files continue to be free from any type of malware. In the event that for whatever reason, a virus is detected or activated despite our best efforts to prevent such an occurrence, The TRUSTED CCTV Improvement Project shall not be held liable for any effect, damage or disadvantage that may result.  

 

Where alternative formats may be required for specific purposes, for example .doc or .rtf format, all reasonable steps will be taken to accommodate any request. Where additional costs may be incurred in the preparation or discharge of alternative format files, these costs will be advised, confirmed and agreed by all parties, prior to acceptance of any order.

 

Whilst the supply of documents and materials can be made to most countries, The TRUSTED CCTV Improvement Project reserves the right to refuse supply to any location, without justification, where to do so may not be in it's best interests. In so far as any particular countries or locations are listed as unacceptable for trading purposes by the UK Government, European Union, or any other relevant organisation or authority, again The TRUSTED CCTV Improvement Project reserve the right to refuse supply at such time as it is deemed unacceptable or inappropriate.

 

We will normally deliver the documents or materials ordered to the address or e-mail address specified at the time of ordering. 

 

Delivery will be made and completed according to the relevant information on the product pages, after your order is accepted.

 

We will use all reasonable endeavours to ensure the order is completed on any specified date agreed, or if no date is specified, within 28 days after the day on which we accept an order. In the case of unforeseen circumstances beyond our reasonable control, we may not be able to supply the items ordered within these timescales and we will not be liable for any delay (loss or disadvantage) or failure to deliver the items ordered, if the delay or failure is wholly or partly caused by such circumstances which are beyond our control.

 

In the event that a delivery does not take place, we will endeavour to agree an alternative delivery date, or in exceptional circumstances, agree to cancel the order and refund any monies paid, less any costs or expenses that may have been incurred by us in the preparation or execution of the order.

 

In the event that any physical goods ( for example, hardcopy documents ) are delayed for whatever reason, we will endeavour to expedite a speedy resolution by whatever means are deemed appropriate and available. The TRUSTED CCTV Improvement Project shall not be held liable at any time, for any loss, costs or disadvantage resulting from non delivery of items ordered, whether due to circumstances within or beyond our control.

 

In the event that all items ordered are not available for a completed delivery to be expedited within five working days of receipt of order, the purchaser will be advised accordingly of estimated delivery dates, and subject to mutual agreement, will either be supplied in the form of multiple deliveries, or alternatively a completed order comprising all items required supplied in a single delivery on an agreed date.

 

 

6. PAYMENT

Payment in full must be received in advance before any order can be processed and the goods dispatched, unless otherwise agreed in advance, in writing.

Payment for goods can be made by any of the payment methods available in the e-shop 'Checkout'; for example, PayPal, Credit Card or Debit card. Alternatively, arrangements can be made to accept payments by other means, subject to agreement and written confirmation.

 

Where payment is made at the 'Checkout', funds will normally be charged / transferred on acceptance of the order, and prior to the order being dispatched. Where any additional or alternative details are provided under the payment methods section of the e-shop, this will be the most up to date information, and that which applies at the time of ordering.

 

 

7. RIGHT TO CANCEL

You have the right to cancel your order for whatever reason, up until the point where the items ordered are despatched. Notification to cancel may be supplied using the 'Contact' form linked from each page of the site, or alternatively send an email advising both the order details and reason for cancellation, to info@trustedcctv.org

 

Where an order has been cancelled, and subject to no costs having been incurred by us up to the point of cancellation, any monies paid will be refunded in full. In the event that any costs are incurred in processing the cancellation of an order ( for example, currency conversion fees ), these costs will be advised, and subsequently deducted from any monies received.

 

In exceptional circumstances, where additional costs have been incurred by The Trusted CCTV Improvement Project as a result of an order being cancelled ( for example, a bulk order for hard copy documents that have been printed, and then subsequently cancelled before delivery ), we reserve the right to levy an appropriate charge to offset any costs incurred.

 

In exceptional circumstances, where goods other than digital or electronic files are required to be returned for whatever reason ( for example, printing errors or quality issues with hard copy documents ), the items must be returned to the correct specified address, carriage paid, before any action is taken to process the cancellation.

The TRUSTED CCTV Improvement Project will not be held liable for any additional costs or disadvantages that result from a request to cancel an existing order, or for the underlying reason for cancellation.

 

The purchaser will not have a right to cancel an order for the supply of any items or services:- 

where the price may be dependent on fluctuations in the financial market which are outside of our control; 

or materials, documents or services are customised or personalised, and are therefore unsuitable for resale to an alternative purchaser.

 

 

8. REFUNDS POLICY

Unless otherwise requested, any agreed refund of monies will normally be repaid by the same ( or reverse ) method in which they were original received.

 

In the event that an order is cancelled prior to despatch, we will refund  any monies paid, less any costs incurred in the preparation or cancellation of the order.

 

We reserve the right to make a deduction from the amount of the refund for loss in value of any physical goods returned where the items show signs of unreasonable use; for example, hard copy documents or publications that are no longer in 'as new' condition.

 

If a purchaser is not satisfied with any product or service, for any reason, for example if incorrect goods or services are supplied or they are received damaged or defective, or an incorrect quantity is supplied, shortages or problems with any items supplied must be notified within 72 Hours of receipt. Written notification of any issues should be made by using the 'Contact' button on each page of the site, or alternatively by sending an email to: info@trustedcctv.org

 

Any notification will normally receive a response within 48 hours, or sooner wherever possible, advising of what steps if any need to be taken by the purchaser, and how the reported issue will be dealt with.

 

If return of any physical goods supplied is requested, provided they are received back in 'as new' condition within 28 days of the original delivery, a full refund will be made for incorrect, damaged or defective items, where there is a genuine cause for complaint. Alternatively, replacement items of an exact or equivalent type may be supplied if requested and agreed by both parties.

 

Where a refund has been agreed, notification will normally be sent by e-mail within 7 days, and the monies returned to the purchaser no later than 7 days after notification.

 

 

9. CANCELLATION BY US

We reserve the right to cancel any order, for whatever reason is deemed appropriate or necessary at the time; for example, a lack of available items, or problems in effecting a delivery to a particular location. Where an order has been cancelled, we will notify the purchaser by e-mail or by any other appropriate method, and return any monies paid at the earliest opportunity ( normally by the same method as payment was originally made ).

 

 

10. TITLE AND RISK

You will become the owner of the goods you have ordered when they have been delivered to you and we have received clear funds in full payment for the goods. Once goods have been delivered to you or a person nominated by you they will be held at your own risk and you will be responsible for them.

 

In the case of documents clearly intended for single site use, whether supplied electronically or in hardcopy format, these may only be applied to the premises, site or location notified to the TRUSTED CCTV Improvement Project. In situations where a single use document is required for use on multiple premises, sites or locations, permission must be sought and obtained in writing from The Trusted CCTV Improvement Project ( use the 'Contact' facility on site, or e-mail to info@trustedcctv.org ).

Where multiple use documents are required, or authorisation is sought for applying existing documents to more than one location, additional fees will apply that will need to be paid prior to the document/s being used. 

 

If multi site use is required, a purchaser should make this clear prior to ordering, so that a detailed and accurate cost can be provided for this facility.

 

 

11. LIABILITY

To the extent not prohibited by law, The TRUSTED CCTV Improvement Project will not accept liability for any:

loss or disadvantage which is not foreseeable, any loss or disadvantage which arises when we are not at fault or in breach of these Terms and Conditions; and

any business loss (which includes loss of profits, loss of business, contracts, goodwill, business opportunity and other similar losses, as well as business interruption)

 

Nothing in these terms will affect any liability we may have: (a) for fraudulent misrepresentation; (b) for death or personal injury arising from our negligence: (c) under Part I of the Consumer Protection Act 1987;

(d) for breach of any condition as to title or quiet enjoyment of or in relation to any goods supplied by us; or

(e) in relation to any other liability, including any liabilities under sale of goods or supply of services legislation, that may not by applicable law, be excluded or limited.

 

 

12. EVENTS BEYOND OUR CONTROL

We will have no liability to any purchaser for any delay in delivering goods that have been ordered, that is caused by any event or circumstance beyond our reasonable control (including, without limitation, accidents, extreme weather conditions, fire, explosion, flood, storm, earthquake, natural disaster, failure of telecommunications networks, inability to use transport networks, acts of God, terrorist attack, war, civil commotion, riots, strikes, lockouts and other industrial disputes, acts or restraints of Government, and imposition of restrictions on imports or exports).

 

 

13. GENERAL

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the validity, legality or enforceability of any other part of these Terms and Conditions and the remainder of the provision in question will not be affected.

 

No person other than the purchaser and us shall have any rights to enforce our agreement, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

 

If we fail to insist that a purchaser performs any of the obligations under our agreement, or if we do not enforce our rights against a purchaser, or if we delay in doing so, that will not mean that we have waived our rights against the purchaser, and will not mean that the purchaser does not have to comply with those obligations. 

 

If we do waive a default by a purchaser, we will only do so in writing, and that will not mean that we will automatically waive any later default by them.

A purchaser may not assign or transfer any rights or obligations under our agreement, unless agreed by both parties in writing.

 

We may update, vary and amend these Terms and Conditions from time to time without prior notice. All purchasers should be aware that each time an order or purchase is made, the Terms and Conditions in force at that time will apply (as set out in this section of the site).

14. LAW AND JURISDICTION

These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. The purchaser and The TRUSTED CCTV Improvement Project agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if the purchaser is resident in Northern Ireland or Scotland, proceedings may also be brought in Northern Ireland or Scotland as appropriate to them
